Justice Stephen J. Field was the champion of a form of liberalism often said to be especially friendly to capitalism, the approach to the Constitution traditionally identified with “Lochnerism,” i.e., a laissez-faire oriented judicial activism. More recently a form of judicial revisionism has arisen, challenging the accepted descriptions of “Lochnerism” and of Field's jurisprudence. This article is an attempt to extend the revisionist approach by arriving at a more satisfactory understanding of the grounding of Field's jurisprudence in the natural rights (...) philosophy. Field, it turns out, orienting around natural rights, was not so unambiguously friendly to capitalism as previous generations of scholars maintained, but his approach is surely friendlier than the constitutional theories that have replaced natural rights since Field's day. These essays center around two questions: Does truth have an underlying nature? And if so, what sort of nature does it have?

Pluralism about truth is the view that there is more than one way for a proposition to be true. When taken to imply that there is more than one concept and property of truth, this position faces a number of troubling objections. I argue that we can overcome these objections, and yet retain pluralism's key insight, by taking truth to be a multiply realizable property of propositions.

Topics explored include ethical, curriculum and pedagogical dimensions, involving invertebrates, engineering solutions that contribute to ecosystems, the experiences of animals under our care, aesthetic and contemplative practices alongside science, school-based ethical dialogue, nature study for promoting inquiry and sustainability, the challenge of whether animals need to be used for science whatsoever, reconceptualizing museum specimens, cultivating socioscientific issues and epistemic practice, cultural integrity and citizen science, the care and nurturance of gender-balanced curriculum choices for science education, and theoretical conversations around cultivating critical thinking skills and ethical dispositions. The diverse authors in this book take on the logic of domination and symbolic violence embodied within the scientific enterprise that has systematically subjugated animals and nature, and emboldened the anthropocentric and exploitative expressions for the future role of animals. At a time when animals are getting excluded from classrooms (too dangerous! too many allergies! too dirty!), this book is an important counterpoint. Interacting with animals helps students develop empathy, learn to care for living things, engage with content. We need more animals in the science curriculum, not less. In this book, Michael P. Berman uses Merleau-Ponty’s thought to develop a critique, grounded in his phenomenology, of certain issues in the philosophy of religion such as faith, love, vision, soul, magic and miracles, judgment, evil, and hallowing.

Beginning in earnest in the late 1990s, educational researchers devoted increasing attention to the study of “active learning,” leading to a robust literature on the topic in the scholarship of teaching and learning. Meanwhile, during largely the same period, political theorists discovered the radical philosophy of Giorgio Agamben, which soon after began to ripple through more radical forms of philosophy of education. While both the SoTL works on active learning and writings of “Agambenian” philosophers of education have offered new insights (...) into their respective fields, active learning has not yet received a systematic philosophical reflection and the community of Agambenian philosophy of education has not yet been systematized. This article addresses both gaps, first through an outline of existing Agambenian approaches to the philosophy of education and second by theorizing active learning as a form of “destituent potential.” The systematic reflection on the three threads of Agambenian philosophy of education—whatever, potentiality, and study—offers an introduction to less familiar readers, and the second section offers a model for how philosophical concepts can become theoretical tools for SoTL analysis. Evidence-based medicine has always required integration of patient values with ‘best’ clinical evidence. It is widely recognized that scientific practices and discoveries, including those of EBM, are value-laden. But to date, the science of EBM has focused primarily on methods for reducing bias in the evidence, while the role of values in the different aspects of the EBM process has been almost completely ignored.

The Western world is currently gripped by an obsessive concern for the rights of animals - their uses and abuses. In this book, Leahy argues that this is a movement based upon a series of fundamental misconceptions about the basic nature of animals. This is a radical philosophical questioning of prevailing views on animal rights, which credit animals with a self-consciousness like ours. Leahy's conclusions have implications for issues such as bloodsports, meat eating and fur trading.

The totalizing and absolutizing tendencies of metaphysics can undermine our essential ethical relationality. Is there a metaphysics that is robust enough and conducive to preserving this intuition? In answer, this paper will draw upon Martin Buber and Justus Buchler. Buber’s seminal work, I and Thou, explores the nature of the ethical encounter. Buchler’s Metaphysics of Natural Complexes develops a general ontology, which can be described as an ordinal metaphysics. Encounters are thoroughly relational for Buber. Buchler’s metaphysics is also thoroughly relational. (...) A phenomenological approach to relationality establishes the medium for this dialogue and provides a common ground for these texts. Not only is there a way to account for Buber’s encounter, but there is also an inherent moral understanding in Buchler’s metaphysics that preserves and is conducive to ethical relationality. Buchler’s metaphysics avoids the totalizing and absolutizing tendencies derided by Buber, while simultaneously promotes a version of the encounter. (shrink)

Through various applications of the ‘deep structure’ of moral and religious reasoning, I have sought to illustrate the value of a morally informed approach in helping us to understand the complexity of religious thought and practice…religions are primarily moved by rational moral concerns and…ethical theory provides the single most powerful methodology for understanding religious belief. The first part of this essay asks: What is the function, purpose and value of a museum? Has any museologist or philosopher given a credible account of philosophical problems associated with museums? Is there any set of properties shared by the diverse entities called museums? Overgeneralization is the principal problem here. The essay then examines a central kind of museum experience; one that invokes and relies upon nostalgia. I argue that the attraction of museums are varied but are best explained (...) affectively and in terms of the orectic rather than cognitively conatively. Although this need not be taken as conflicting with the idea that museums are focused on scholarship, it is more consonant with the claim that exhibitions are central. Museums may at times both pique and satisfy our curiosity. However it is a mistake to see ‘curiosity’ as merely, or even primarily, a matter of cognition. (shrink)

Research on neural transplantation has great potential societal importance in part because of the expanding proportion of the population that is elderly. Transplantation studies can benefit from the guidance of research on cognitive aging, especially in connection with the assessment of behavioral outcomes. Speech for example, might be explored using avian models.

This article explores the influence of idiomatic syntactic constructions (i.e., constructions whose phrase structure rules violate the rules that underlie the construction of other kinds of sentences in the language) on the acquisition of phrase structure. In Experiment 1, participants were trained on an artificial language generated from hierarchical phrase structure rules. Some participants were given exposure to an idiomatic construction (IC) during training, whereas others were not. Under some circumstances, the presence of an idiomatic construction in the input aided (...) learners in acquiring the phrase structure of the language. Experiment 2 provides a replication of the first experiment and extends the findings by showing that idiomatic constructions that strongly violate the predictive dependencies that define the phrase structure of the language do not aid learners in acquiring the structure of the language. Together, our data suggest that (a) idiomatic constructions aid learners in acquiring the phrase structure of a language by highlighting relevant structural elements in the language, and (b) such constructions are useful cues to learning to the extent that learners can keep their knowledge of the idiomatic construction separate from their knowledge of the rest of the language. Merleau-Ponty and Buddhism explores a new mode of philosophizing through a comparative study of Maurice Merleau-Ponty's phenomenology and philosophies of major Buddhist thinkers including Nagarjuna, Chinul, Dogen, Shinran, and Nishida Kitaro. The book offers an intercultural philosophy in which opposites intermingle in a chiasmic relationship, and which brings new understanding regarding the self and the self's relation with others in a globalized and multicultural world.

Much of the literature on speech acts and semantics assigns a type of theoretical priority to assertions; many philosophers assume, as Robert Brandom has put it, that assertion is the fundamental speech act. Others take a more pluralistic approach, with many categories interwoven as peers, and no one category as fundamental. I suggest there is a way to embrace a pluralistic approach and explain the importance of assertions without making them fundamental. Their role instead becomes one of supporting connections between (...) other categories, and surprisingly, turns on their unusually broad but very thin pragmatic character. (shrink)

This article addresses recent claims made by Richard Rorty about antirepresentationalist theories of meaning. Rorty asserts that a faithful rendering of the core antirepresentationalist assumptions precludes even revised pieces of representationalist semantics like "refers" or "true" and epistemological correlates like "answering to the facts." Rorty even asserts that such notions invite reactionary authoritarian elements that would impede the development of a democratic humanism. I reject this claim and assert that such notions (suitably constructed) pose no greater threat to democratic humanism (...) than the alternatives and in fact are crucial to its maintenance and continuing success. These notions (suitably constructed) reflect a metatheoretical stance that I call "openness," which I believe lies at the heart of both democratic humanism and the pragmatism from which Rorty claims to take his inspiration. Minimalists generally see themselves as engaged in a descriptive project. They maintain that they can explain everything we want to say about truth without appealing to anything other than the T-schema, i.e., the idea that the proposition that p is true iff p. I argue that despite recent claims to the contrary, minimalists cannot explain one important belief many people have about truth, namely, that truth is good. If that is so, then minimalism, and possibly deflationism as a whole, must (...) be rejected or recast as a profoundly revisionary project. (shrink)
